These are the Terms and Conditions of sales applys to all the transactions for the purchase of EPL products ("Products") and from Explocity Pvt Limited ("EPL") through its website www.explocity.com and any associated webpages (the "Site"). These condition should also be read in conjunction with Epl's Terms and Conditions of use, Terms, Disclaimers and Privacy Policy. These Terms represents the complete Aggreement between EPL and You covering the sales of Product from this site. EPL does not offers or agrees to any conditions, warranties and guarantees or representations relating to the quality, descriptioon or performance characteristics of the product other than those set out in these terms, except for terms implied by applicable laws & statues. All orders are subject to acceptance by EPL and your submission of completed filled order form, on this site will constitute an offer from you to purchase Products (the "Order"). This agreement is governed by the courts of Mumbai, India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Mumbai, India in all disputes arising out of or relating to the use of the Explocity.com Sites/Services. PRICES EPL's current selling price on the date of receipt by EPL of the Order, less any applicable discounts in effect at that time will be the price to be paid by you. EPL reserves the right to change its prices from time to time without prior notice to you. All prices in this website include applicable taxes. With respect to applicable taxes if not included in the prices mentioned online and / or if subject to revision, EPL will advise you subsequently of the exact amount of tax due on your purchase. You are responsible for paying the entire amount due on your purchase irrespective of the time taken to deliver the product, including any applicable taxes, shipping and other charges assessed by the EPL after you have clicked on “Confirm Order” button. STOCK AVAILABILITY EPL will contact you at the e-mail ID provided by you, if the product is "out of stock" when EPL processes an Order, to discuss revised delivery times or refund options. ORDER DELIVERY AND CANCELLATION You must complete all information requested on the Order form before the Order is processed by EPL. You must ensure that all Orders placed by you under this Agreement must be through the forms provided on this Site and must specify the information requested EPL will confirm by e-mail (at the ID given by you in the completed order form) acceptance or otherwise the receipt of a confirmed order from you. However, EPL is not responsible for delivery of the e-mail. DELIVERY Please ensure that all the details are filled in correctly before confirming the order. Delivery will be made to the Shipping address mentioned in the order form. In case of any changes to be made in the delivery address, please intimate the same to us at foodguideorders@gmail.com FREIGHT METHOD & FULFILLMENT EPL will arrange delivery of all Products to the Customer using its nominated freight carrier/s / logistics partner/s. We will commence the Shipment process of a product 48 hours after acceptance of an Order. EPL asserts that, from time to time, in event of EPL being subject to any reasonable production, delivery or other unforeseen delays, EPL may alter the schedule & priority for despatch of the product/s ordered by you at its sole discretion. EPL also reserves the right to make partial delivery of an Order. In case your order has not been delivered within a reasonable time, you should contact EPL at: foodguideorders@gmail.com PAYMENT Payment for Products purchased from EPL has to be made by credit cards via the secure payment gateway. EPL reserves the right to cancel delivery if your credit card provider or the payment gateway rejects a payment when due. CANCELLING AN ORDER EPL will endeavour to accommodate your request to cancel an Order prior to shipment, if the merchandise has not shipped. You must contact EPL Customer Service immediately by e-mail to foodguideorders@gmail.com PRODUCTS DAMAGED IN TRANSIT Any Claims for alleged damage to Products caused in transit from EPL to the destination specified by you must be notified to EPL within 24 hours of receipt of delivery. DELIVERY OUTSIDE MUMBAI, INDIA EPL will accept Orders or deliver to addresses outside Mumbai and also outside India subject to your agreeing to the Terms & Conditions and paying the necessary shipping and handling charges as applicable and mentioned on the website. AMENDMENT OF TERMS AND CONDITIONS EPL may revise these terms and conditions from time to time. You should therefore periodically visit this page to familiarise yourself with any such revisions. The terms and conditions, deemed to have been accepted when communicating your request, are as under: 1. These terms and conditions are to be read together with the Disclaimer and Privacy Policy of Explocity.com 2. The acknowledgement received from our logistic partners showing acceptance of the products sent by courier will be proof of receipt of the product / services requested by you. 3. The address at which delivery of the product requested by you are to be made should be correct and proper in all respects. DISCLAIMER 1. www.explocity.com makes no representations or of any kind, express or implied, as to the operation of the site, the information, or content, included on this site. 2. www.explocity.com makes no guarantee of availability of product or service and reserves the right to change, withdraw, suspend, or discontinue any functionality or feature of the product / services. A third party cannot evaluate the benefits of some of the services. 3. To the full extent permissible by applicable law, Explocity.com disclaims all warranties, express or implied. Explocity.com will not be liable for any damages of any kind arising from the use of this site or any of the services offered, including but not limited to direct, indirect, incidental, punitive and consequential damages. 4. Explocity.com is not responsible if you are not satisfied about the benefits of our product / services. 5. By confirming an order or sending us a mail, you signify your agreement to these Terms and Conditions and you will not have any claim for refund of your monies/ payments that you send to www.explocity.com 6. You agree that EPL, despite its best efforts may not be able to deliver merchandise as indicated on the website. 7. You agree that EPL has no responsibility or liability for the delayed delivery of the product / service. You acknowledge that EPL reserves the right to deliver your order at any time. 8. EPL MAKES NO WARRANTY THAT ANY SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. I have read, understood and accepted the Terms and Conditions put forth by Explocity Private Ltd. in Privacy Policy, Disclaimer, About Explocity and other places on the site as they appear from time to time.
